Electoral Justice Reform Committee

Inaugurated on the 7th of September, by Joseph Bodunrin Daudu SAN, President of the NBA, this committee’s terms of reference are as follows:

  1. To examine critically the INEC Act 2010 and advise on its suitability, comprehensiveness and adaptability for the conduct of the 2011 General Elections.
     
  2. Examine specifically, the time frame outlined in the INEC Act 2010 and pronounce on the constitutionality or otherwise of the time restrictions placed on the determination of Election Petitions.
     
  3. Examine critically the practicability of finalizing election petition within the period of 180 days particularly with reference to the provision that all unconcluded petitions shall be struck out upon the expiration of 180 days.
     
  4. Examine the constitutional reforms as to which courts will not be the final Court of Appeal for Governorship matters, particularly the provisions which make the Court of Appeal the Court of first instance for disputes arising from the Governorship and Presidential Elections.
     
  5. Review the existing Practice Directions, Court of Appeal Rules and other Procedural Rules as it relates to the resolution of election disputes and proposed amendments if necessary to the President of the Court of Appeal and or the National Assembly.
     
  6. Inquire into the allegations of corruption leveled against members of the judiciary and proffer suggestions as to how to eradicate or curb to the nearest minimum all acts of corruption in the judicial stratosphere.
     
  7. To do any other thing that in the Committees opinion will assist in bringing reform to the electoral processes.
